VPSCellar – Terms of Service

1. Parties & Definitions

These Terms of Service ("Terms") form a binding contract between VPSCellar OÜ ("VPSCellar", "we", "our") and you (the individual or legal entity purchasing or using our Services). "Services" means the virtual private servers (VPS) and any related features made available at https://vpscellar.com (the "Site").

By provisioning or paying for a VPS you confirm that you have read, understood, and agree to these Terms.

2. Scope of Service

2.1 VPSCellar is responsible for the physical host node, core network, and hypervisor layer.

2.2 You are fully responsible for everything inside your VPS—operating‑system configuration, software installation, updates, security hardening, backups, and the legality of the content you host or distribute.

3. Support

3.1 Standard support is available 07:00–21:00 UTC via email (vpscellar@gmail.com) or Telegram (@vpscellar). First response time target: ≤ 24 h.

3.2 Support covers host‑level issues (hardware, hypervisor, network). We don’t debug your code or third‑party applications.

4. Payment

4.1 All plans are prepaid in cryptocurrency. Fiat payments are not currently supported.

4.2 Service activation occurs after on‑chain confirmation of full payment.

4.3 Prices are displayed exclusive of any VAT/sales tax that we may be legally required to collect.

5. Refund Policy

5.1 A 3‑day money‑back guarantee applies to every VPS plan unless the plan is explicitly marked Non‑Refundable on the Site.

5.2 To request a refund, open a ticket within 72 hours of service delivery.

5.3 Refunds are sent in the same coin & network you paid with, minus non‑refundable network fees.

6. Service Level Objective

6.1 We aim for 99.9 % monthly uptime at the hypervisor port.

7. Acceptable Use Policy (AUP)

You must not use the Services to:

  • Host or distribute content that is illegal under United States, European Union, or applicable local law (e.g., child sexual abuse material, extremist propaganda, or hate speech);
  • Infringe copyright or trademark (including DMCA violations);
  • Run open relays, send unsolicited bulk messages, or otherwise spam;
  • Mine cryptocurrency or run mining pools that sustain ≥ 70 % CPU usage without our written consent;
  • Launch or facilitate DDoS attacks, unauthorized port scans, or penetration tests of third‑party networks;
  • Violate export‑control, trade‑sanction, or embargo regulations;
  • Exceed our Fair Use bandwidth guidelines (we may shape sustained ≥ 10 Gbit/s traffic to 100 Mbit/s for the rest of the billing period).

We may investigate any suspected breach and suspend the VPS immediately if necessary to protect network stability or legal compliance.

8. Suspension & Data Retention

8.1 Non‑payment: Services are suspended 3 days after an unpaid invoice and deleted (including all data) 14 days after suspension.

8.2 AUP breach: We may suspend or terminate the VPS without notice.

8.3 Upon termination you are solely responsible for ensuring you have a backup of your data.

9. Privacy & Data Protection

9.1 Minimal data – We only require an email address to create an account. No KYC documents are requested.

9.2 GDPR – Where the EU General Data Protection Regulation applies, VPSCellar acts as a data processor for customer‑stored data and a data controller for account metadata. You are responsible for ensuring that any personal data processed on your VPS complies with GDPR/CCPA or other local privacy laws.

9.3 Logs – We keep basic service logs (IP addresses, connection times) for security and abuse‑prevention purposes only.

10. Limitation of Liability

To the fullest extent permitted by law, VPSCellar shall not be liable for indirect, incidental, special, punitive, or consequential damages, or for loss of profits, revenue, data, or goodwill.

Our aggregate liability for any claim will not exceed the amount you paid for the affected Service during the three (3) months preceding the event.

11. Indemnification

You agree to indemnify and hold harmless VPSCellar, its officers, and employees from any claim or expense (including reasonable legal fees) arising out of your content, your use of the Services, or your breach of these Terms.

12. Changes to Terms

We may update these Terms by posting a new version on the Site. Material changes take effect 14 days after posting. Continued use of the Services after that date constitutes acceptance.

13. Severability

If any provision of these Terms is held unenforceable, the remaining provisions will remain in effect.
